Controller and legal basis

The present notice (or “Cookie Policy”) has been drafted in accordance with Art. 13 of the EU Regulation 679/2016 (General Data Protection Regulation, or “GDPR”) by DeA Capital Alternative Funds SGR S.P.A., with registered office in Milan, Via Brera n. 21, e-mail [email protected], in the role of Data Controller (“Controller”). It describes the manner of processing personal data related to the use of cookies on the site www.deacapitalaf.com (“Website”). What are cookies

Cookies are small text files which the sites visited by the user send and record on the user’s computer or mobile device, which are then retransmitted to back to the same sites at the user’s next visit. It is thanks to cookies that a site remembers the user’s actions and preferences (such as, for example, log-in data, their preferred language, font size, other viewing settings, etc.) so that they do not need to be indicated again when the user returns to the site or goes from one of its pages to another. Cookies are thus used to carry out authentication processes, session monitoring and the memorization of information about the browsing preferences of users who access a site. They may also contain a unique identification code that makes it possible to track the user’s browsing on the site for statistical or advertising purposes. Some operations cannot be carried out without the use of cookies, which in certain cases are therefore necessary from a technical point of view for the site to function properly.

While browsing on a site, the user may also receive on their computer or mobile device cookies from websites or web servers other than the one which they are visiting (so-called “third-party” cookies, on the condition that it is not possible to use them to learn the identity of the user). The various types of cookies, depending on their characteristics and functions, can remain on the user’s computer or mobile device for different periods of time: for example, “session” cookies are automatically deleted when the browser is closed, while “persistent” cookies remain on the user’s device until a preset expiration date.

According to current Italian law, the express consent of the user is not always required for the use of cookies. In particular, consent is not required for so-called “technical cookies”, namely those used for the sole purpose of carrying out the transmission of communications on an electronic communications network, or to the extent strictly necessary for providing a service explicitly requested by the user. They are, in other words, the cookies that are required for a site to work or necessary to perform the activities requested by the user.

The Italian Data Protection Supervisor considers the following types of cookies to be technical cookies, which do not require express consent for their use:

  • “analytics cookies” used directly by the website manager to collect information, in aggregate form, about the number of users and how said user visits the site, or by third parties in aggregate and anonymized form;
  • browsing or session cookies (for authentication);
  • functional cookies, which allow the user to browse based on a series of criteria selected (for example, the language, etc.) for the purpose of improving the service provided to said user.

Cookies used by the Website

The Website uses technical cookies (part of the category of “first-party cookies”).

Technical cookies are those used for the sole purpose of carrying out the transmission of a communication on an electronic communications network, or of transmitting to the provider information that is strictly necessary in order to provide a service explicitly requested by the user.

Normally, they are installed at the moment of access to the website directly by the controller or manager of the website.

They can be subdivided into:

  • Browsing or session cookies: these guarantee the normal browsing and use of the website; indeed they are necessary for the site to function properly.
  • Analytics cookies: these count as technical cookies when they are used directly by the manager of the web site or by third parties to collect information in aggregate form about the number of users and how these users visit the site, in order to improve the site’s performance. This category includes the cookies set up by Google Analytics, which collects information about the use of the site by visitors in anonymized form.
  • Functional cookies: these allow the user to browse based a series of criteria selected (for example, the language, etc.) for the purpose of improving the service provided to said user.

DURATION OF THE PROCESSING

Session cookies expire at the end of browser session (normally when the browser is closed or when the session expires). The storage period of persistent cookies, on the other hand, is equal to the duration indicated in the table above.

Scope of communication and dissemination of personal data

HOW WILL THE DATA PROCESSING BE CARRIED OUT?

The processing of the browsing data collected by the Controller with the cookies managed by them, will be carried out by means of electronic and/or telecommunications tools, with procedures strictly correlated to the purposes as indicated in the previous section, and in any event in such a manner as to guarantee the security and confidentiality of said data.

Rights regarding complaints

LODGING COMPLAINTS

In regards to any type of data processed by the Controller, the User has the right — if they believe that the processing of their browsing data has occurred or is occurring in violation of the GDPR and of the applicable regulations at the time, and with no prejudice to their right to file an appeal to any other court — to lodge a complaint with the Supervisory Authority for personal data protection, in the manner indicated on the site www.garanteprivacy.it.
